1. Our Respect for Copyright

BidBudz respects the intellectual-property rights of others and expects the people who use our service to do the same. This Policy explains how a copyright owner (or someone authorized to act for one) can report material on BidBudz they believe infringes their copyright, and how BidBudz responds. It is provided under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

This Policy forms part of the BidBudz Terms of Service.

2. Designated Agent

BidBudz has registered a designated agent with the U.S. Copyright Office to receive notifications of claimed copyright infringement. Send all DMCA notices to:

3. How to Send a Takedown Notice

To be effective under the DMCA, your written notice to our designated agent must include substantially all of the following:

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
2. Identification of the copyrighted work you claim has been infringed (or a representative list, if multiple works).
3. Identification of the material you claim is infringing, with enough detail for us to locate it — for example, the page URL or the specific item on BidBudz.
4. Your contact information: name, mailing address, telephone number, and email address.
5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.

An incomplete notice may delay our response. If your notice is missing required elements, we may contact you so it can be corrected.

4. What We Do With a Valid Notice

When we receive a notice that reasonably complies with the DMCA, we will:

• remove or disable access to the material identified in the notice, generally within five (5) business days;
• make a reasonable effort to notify the person who submitted or is responsible for the material; and
• keep a record of the notice, the material, our action, and the date.

Because BidBudz reviews and publishes content through a human moderation process, removing reported material is part of our normal editorial function and does not make us the author of any user-submitted material.

5. Counter-Notification

If you believe your material was removed or disabled by mistake or misidentification, you may send a written counter-notification to our designated agent that includes substantially all of the following:

1. Your physical or electronic signature.
2. Identification of the material that was removed or disabled, and the location where it appeared before removal.
3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
4. Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the district where your address is located (or, if outside the United States, any district in which BidBudz may be found), and that you will accept service of process from the person who sent the original notice or their agent.

If we receive a valid counter-notification, we may restore the material in 10 to 14 business days unless the original complaining party notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.

6. Repeat Infringers

BidBudz will, in appropriate circumstances, disable or terminate the accounts of users who are determined to be repeat infringers.

7. Misrepresentations

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that it was removed or disabled by mistake or misidentification, may be liable for damages. Please be sure of your rights before submitting a notice or counter-notification.

8. Changes to This Policy

We may update this Policy as our services or legal obligations change. The updated Policy will be posted with a revised "Last Updated" date.
